The Environmental Protection Agency’s (EPA’s) Local Government Advisory Committee (LGAC) and the U.S. Army Corps of Engineers recently released a proposed rule regarding jurisdiction of the Clean Water Act (CWA). The proposed rule is intended to clarify which waters are subject to CWA jurisdiction. EPA maintains that the proposed rule does not change its jurisdiction but only provides greater clarity and certainty as to what constitutes a “water of the U.S.” For more information, review the proposed rule in the Federal Register.
